Terms of Service

Last updated: January 1, 2025. Please read these terms carefully before using ApexChess.

By accessing or using ApexChess (the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these Terms, you must discontinue use of the Platform immediately. These Terms constitute a legally binding agreement between you and ApexChess.
01.

Acceptance of Terms

By creating an account, registering for a tournament, or otherwise accessing the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

ApexChess reserves the right to modify these Terms at any time. Continued use of the Platform after any changes constitutes acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes.

02.

Eligibility

You must be at least 18 years of age to create an account or participate in any tournaments on ApexChess. By using the Platform, you represent and warrant that you meet this age requirement.

The Platform may not be available in all jurisdictions. You are responsible for ensuring that your use of the Platform complies with all laws and regulations applicable in your location.

Accounts may not be created by automated means or on behalf of another person without their explicit written consent.

03.

Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify ApexChess immediately upon becoming aware of any unauthorized use of your account.

Each person may hold only one active account on the Platform. Creating multiple accounts to gain an unfair advantage in tournaments is prohibited and may result in permanent suspension of all associated accounts.

You agree to provide accurate, current, and complete information when creating your account and to update such information as necessary to keep it accurate and complete.

04.

Tournament Participation

By registering for a tournament, you agree to be available and online at the scheduled tournament start time. A 15-minute grace period will be granted; failure to join within the grace period may result in automatic disqualification.

Players are solely responsible for ensuring a stable internet connection. ApexChess bears no liability for losses resulting from connectivity issues on the player's end. Repeated disconnections may be treated as a withdrawal from the tournament.

Once a player registers for a tournament, the registration cannot be canceled and entry fees (where applicable) are non-refundable, except in the event of a tournament cancellation by ApexChess.

All tournament-related decisions made by ApexChess administrators are final and binding.

05.

Fair Play Rules

The use of chess engines, bots, scripts, automation tools, external assistance software, or any other form of computer-aided analysis during a live tournament match is strictly prohibited.

Players may not collaborate with or receive assistance from other individuals during their tournament matches. ApexChess reserves the right to use automated game analysis tools to detect potential violations.

Any player found to be in violation of fair play rules may be immediately removed from the tournament, have their results voided, and face temporary or permanent account suspension.

06.

Disqualification Rights

ApexChess reserves the right to disqualify any participant at any time for violations of these Terms, including but not limited to: cheating, unsportsmanlike conduct, abuse of platform systems, harassment of other players, or failure to comply with administrator decisions.

Disqualified players forfeit all claims to prizes or refunds associated with the relevant tournament.

07.

Prize Distribution

Prize payouts are processed only after tournament verification procedures are complete. ApexChess reserves the right to delay prize distribution while investigating potential rule violations or suspicious activity.

ApexChess reserves the right to withhold or deny prize payouts to accounts found to be in violation of these Terms, including but not limited to cheating investigations, payment abuse, or multi-accounting.

Prize amounts are calculated based on the final prize pool at the time the tournament closes for registration. ApexChess is not responsible for any taxes owed on prizes received.

08.

Account Suspension

ApexChess reserves the right to suspend, restrict, or permanently terminate any account at its sole discretion if there is reason to believe that the account holder has violated these Terms, engaged in fraudulent activity, or poses a risk to other users or the integrity of the Platform.

Users who believe their account has been suspended in error may contact support to request a review. ApexChess is not obligated to restore suspended accounts.

09.

Limitation of Liability

To the fullest extent permitted by applicable law, ApexChess and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform or any tournament.

ApexChess's total liability to you for any cause of action shall not exceed the total amount paid by you to ApexChess in the twelve months preceding the claim.

ApexChess does not warrant that the Platform will be uninterrupted, error-free, or free from harmful components. Use of the Platform is at your own risk.

10.

Modifications to Terms

ApexChess may update or revise these Terms at any time. The effective date at the top of this page will be updated accordingly. We encourage you to review these Terms periodically.

Material changes will be communicated to registered users via the email address on file or through a prominent notice on the Platform.
